Patent Lawyer Job Description Template
The Patent Lawyer will be responsible for providing legal advice on patent law and intellectual property to clients. They will also be responsible for preparing and filing patent applications, as well as conducting research on patents and patentability. In addition, the Patent Lawyer will represent clients in patent infringement litigation, and provide advice on licensing and other IP-related matters.
Patent Lawyer Job Responsibilities
- Research and analyze patents to determine if an invention can be patented
- Draft patent applications and file them with the USPTO
- Conduct interviews with inventors to obtain information needed for the application
- Work with clients to select the best strategy for protecting their invention
- Represent clients in administrative hearings and court proceedings related to patents
- Provide advice on infringement, licensing, and other legal matters relating to patents
Objectives
- To secure and protect the intellectual property rights of clients through the patent process.
- To conduct patentability searches and provide opinions on patentability.
- To prepare, file, and prosecute patent applications before the USPTO.
- To represent clients in postgrant proceedings before the USPTO, including ex parte and inter partes reexaminations and reissues.
- To represent clients in appeals to the Patent Trial and Appeal Board (PTAB).
- To negotiate and draft license agreements involving patents and other intellectual property rights.
